In New Hampshire, Gay Marriage is Legal, but Adultery is a Criminal Offense

Having decided not to meddle in the private affairs of homosexuals, the New Hampshire
legislature is deciding whether to but out of the bedrooms of consenting heterosexuals. Representatives Timothy Horrigan (D) and Carol McGuire (R) are sponsoring legislation to repeal the state’s 200-year-old law that makes adultery a crime. “We shouldn’t be regulating people’s sex lives and their love lives,” said Horrigan.
In June, the legislature voted to legalize gay marriage, which takes effect January 1.
While lawmakers decide what to do with the adultery law, the current penalty for violating the statute is a $1,200 fine—which is better than being sent to the gallows for 39 lashes, the original punishment.
