Revenge of the Wrongly Foreclosed: Florida Sheriffs Threaten to Seize Bank of America Assets

Many homeowners across the United States have suffered the frustration of having Bank of America try to take away their home even when they were not behind on their mortgage payments and, in some cases, when they didn’t even have a mortgage with Bank of America. This week, in southwestern Florida, one such couple finally got even.
 
In 2009, Warren Nyerges, a retired law enforcement officer from Ohio, and his wife, Maureen, bought a house in Golden Gate from Bank of America. They paid cash, but the following year the bank mistakenly sued them for foreclosure. Bank officials eventually admitted their mistake and dropped the suit. A judge ordered Bank of America to pay the Nyergeses $2,534 to cover their attorney’s fees, but for five months BofA ignored their request.
 
Finally, on Friday, their lawyer, Todd Allen, had had enough. He showed up at the Naples branch of BofA with a court order permitting seizure of assets, as well as a moving company that was prepared to take way the bank’s furniture.
 
After an hour of negotiations and phone calls, the bank handed over a check that covered the Nyerges’ expenses, as well as the Sheriff’s Office fees.
